Booking Terms & Conditions

Please read the following information to ensure that you fully understand the booking process , how payments are made, our booking conditions, our participation waiver forms and our cancellation policy. Please review the following information carefully and do not hesitate to contact us with any questions regarding this information.

Prices

Prices are in CDN Dollars, unless otherwise noted, and include sales tax of 5% GST.

Booking

To book your trip you must fill out the booking form and send the required deposit. You will be contacted afterwards, and directed to fill out our medical form and sign a Waiver of Liability Form. It is essential that any health concerns be reported on the Medical Form. Failure to do so can result in severe consequences in the event of an emergency.

Liability Waivers

You will be required to sign a Waiver of Participation before commencing a trip with us. Signing this waiver is a condition of participation. By signing our Waiver Form, you are aware of the risks associated with wilderness travel and remote adventure tours, and that you are in physical and mentally sound condition to participate in one of our trips.

Deposits and Payments

All bookings require a deposit in order to confirm the trip (deposit amount will be disclosed on the sign up form for each trip). This deposit is non-refundable but transferable to another person or to another event if cancelled up to 20 days before the event. The balance of your trip cost is due 20 days prior to the trip start (unless otherwise noted).

Methods of Payment

We accept e-transfer payments & credit card payments. Please note; Credit Card payments incur an additional 2.5-3% transaction fee. If you wish to pay via credit card please email info@for-rest.ca, and we will send you an invoice and instructions on how to pay using your Credit Card.

Cancellation and Refund Policies

Should For-rest Retreat cancel a trip, a full refund will be made. We will make the final decision to operate or cancel a trip anytime up to, but not later than 1 week before the trip begins.

Should you cancel your booking for any reason the following penalties apply:

If you must cancel your trip up to 20 days before the trip start date, your deposit will be withheld, but any other payments already made will be refunded. You can transfer your deposit to another trip up to 20 days before the trip
Any remaining balance is due 20 days before the trip (unless otherwise noted)
If you cancel within the 20 day period before the trip, the payment will be withheld and you will not be able to transfer the deposit to a future event but you can transfer it to another person..
Any cancelation within the 20 day period is transferable to another person but non-refundable.

Booking Conditions

There is a degree of hazard in all mountain activities and adventure tours taking place in wilderness areas. All participants must read and sign the Participation Waiver Form prior to commencing any trip. Please read this document carefully and take the time to understand its contents, and your awareness of the potential risks associated with wilderness adventure tours, and then sign the waiver. This is required prior to any trip participation with us.

Medical Evacuations

In the unlikely event of an emergency, participants will be required to pay for any rescue or evacuation costs incurred on their behalf or as a result of their actions.

Limitation of Responsibility

For-rest Retreat will, of course, always do its best to ensure the greatest possible safety for all its clients. For-rest Retreat will not be held liable for changes in tour itineraries due to weather conditions, acts of God or special conditions beyond our control.

Should clients encounter problems during their trip they are required to contact For-rest Retreat immediately in order to solve the problem. All concerns should be forwarded in writing to For-rest Retreat within 4 weeks of completion of the trip. Claims received after that date cannot be considered.

An all inclusive accident, health and luggage insurance for your trip is recommended. Please see your travel agent.

Changes to the Itinerary

Many of the activities are weather dependent and cannot be guaranteed. Certain hikes, activities etc may be cancelled on short notice and the itinerary altered to suit the situation as it arises. For-rest Retreat does not offer refunds or credits for cancelled activities or changes to a planned itinerary. We reserve the right to change or cancel any itinerary or service at any time due to insufficient enrolment, bad weather conditions or other reasons without penalty. The participation of any person on any trip is subject to the discretion of the trip leaders.

Waiver of Liability

RELEASE OF LIABILITY, WAIVER OF CLAIMS, EXPRESS ASSUMPTION OF RISK AND INDEMNITY AGREEMENTPlease read and be certain you understand the implications of signing Express Assumption of Risk Associated with hiking, mountain biking, paddleboarding and related activities.

I,

do hereby affirm and acknowledge that I have voluntarily applied to participate in the retreat designated above and understand the inherent hazards and risks associated with hiking, mountain biking, and/or paddleboarding and transportation of equipment related to the activities, and traveling to and from activity sites, in which I am about to engage. Inherent hazards and risks include but are not limited to:

1. Risk of injury from the activity and equipment utilized is significant including the potential for permanent disability and death.

2. Falling, causing broken bones severe injuries to the head, neck and back which may result in severe impairment or even death.

3. All "acts of nature," including but not limited to avalanche, rock fall, inclement weather, thunder and lighting, severe and or varied wind, temperature and other weather conditions.

4. Risks associated with crossing, climbing or down-climbing of rock, snow and/or ice.

5. Risks associated with water and lake activities such as drowning and hypothermia

6. Possible equipment failure and/or malfunction of my own or others' equipment, which may have been rented, borrowed, or personally owned.

7. My own negligence and/or the negligence of others, including employees, agents, independent contractors or representatives of including but not limited to operator failure.

8. Cold weather and heat related injuries and illness including but not limited to frostnip, frost bite, heat exhaustion, heat stroke, sunburn, hypothermia and dehydration.

9. Attack by or encounter with insects, reptiles, and/or animals.

10. Accidents or illness occurring in remote places where there are no available medical facilities.

11. Fatigue chill, and/or dizziness, which may diminish my/our reaction time and increase the risk of accident

12. My sense of balance, physical coordination, and ability to follow instructions.

13.High altitude accident, accident or illness without access to means of rapid evacuation or the availability of medical supplies; and the lack of adequacy of medical attention once provided.

*I understand the description of these risks is not complete and that unknown or unanticipated risks may result in Injury, illness, or death.

Release of Liability, Waiver of Claims and Indemnity Agreement

in consideration for being permitted to participate in any way in hiking and related activities, I hereby agree, acknowledge and appreciate that:

1. I HEREBY RELEASE AND HOLD HARMLESS WITH RESPECT TO ANY AND ALL INJURY, DISABILITY, DEATH, or loss or damage to person or property, WHETHER CAUSED BY NEGLIGENCE OR OTHERWISE, the following named persons or entities, herein referred to as releasees.

2. To release the releasees, their officers, directors, employees, representatives, agents, and volunteers, from liability and responsibility whatsoever and for any claims or causes of action that I, my estate, heirs, survivors, executors, or assigns may have for personal injury, property damage, or wrongful death arising from the above activities whether caused by active or passive negligence of the releasees or otherwise. By executing this document, I agree to hold the releasees harmless and indemnify them in conjunction with any injury, disability, death, or loss or damage to person or property that may occur as a result of engaging in the above activities.

3. By entering into this Agreement, I am not relying on any oral or written representation or statements made by the releasees, other than what is set forth in this Agreement.

This release shall be binding to the fullest extent permitted by law. If any provision of this release is found to be unenforceable, the remaining terms shall be enforceable.

I HEREBY ACCEPT ANY AND ALL RISKS OF ILLNESS, INJURY, EMOTIONAL TRAUMA OR DEATH AND VERIFY THIS STATEMENT BY INITIALING HERE:

RELEASE

AS LAWFUL CONSIDERATION for being permitted by EXHALE ADVENTURES, FOR-REST RETREAT, Johanna Mickle, Chevay Roddick, to participate in such retreat and accompanying activities, I hereby agree that I, my heirs, legal representatives or any member of my family will not make a claim against or sue EXHALE ADVENTURES, FOR-REST RETREAT, Johanna Mickle, Chevay Roddick, or any of their affiliated agents, employees, teachers or volunteers, for bodily injury, death, emotional trauma or property damage resulting from my participation in the retreat. EXHALE ADVENTURES, FOR-REST RETREAT, Johanna Mickle, Chevay Roddick shall not be liable, directly or indirectly, for bodily injury or property damage for any reason whatsoever, including, but not limited to the following causes: acts of God, pandemics, epidemics, detention, annoyance, weather, quarantines, strikes, civil disturbance, theft, negligence including negligence of Johanna Mickle or Chevay Roddick, default, changes in government regulations, terrorism, war or failure of conveyance to arrive or depart as scheduled. I therefore release and discharge EXHALE ADVENTURES, FOR-REST RETREAT, Johanna Mickle, Chevay Roddick, and their agents, employees, teachers and volunteers from and against any and all liability arising from my participation in the retreat even though that liability may arise out of negligence or carelessness on the part of EXHALE ADVENTURES, FOR-REST RETREAT, Johanna Mickle, Chevay Roddick or their affiliate agents, employees, teachers or volunteers. If any portion of this agreement is unenforceable, the remaining portions shall remain in full force and effect. Under no circumstances shall EXHALE ADVENTURES/FOR-REST RETREAT be liable to any retreat participant for more than the land cost of the retreat applied for on this document. I waive any charge-back rights and, in the event of dispute, requests for a refund will be made using the procedures described under the “Cancellation and Refunds” section below. All applications are subject to acceptance by EXHALE ADVENTURES/FOR-REST RETREAT. Upon acceptance of my application, this agreement shall be deemed to have been entered into at Salmo, British Columbia and shall be construed according to the laws of the province of British Columbia. In the unlikely event a legal dispute should arise involving any subject matter whatsoever, I agree that the exclusive venue for any legal action shall be Salmo, British Columbia, Canada.

CANCELLATION AND REFUNDS

The Retainer is non-refundable but can be transferred to another person or event put on by Exhale Adventures or For-rest Retreat if cancellation occurs 20 or more days before departure. Any cancellation made between 1-20 days before the start date will result in a total loss of your trip retainer. Any cancellation between 1-7 days will result in a total loss of funds. We reserve the right to cancel the trip if it does not meet the trip minimum (if we do so, your trip retainer is refunded).
Trip cancellation insurance is strongly recommended if there is a possibility that you might have to cancel your trip. All cancellations and/or any refund requests must be made in writing to For-rest Retreat before our trip departs. Our email address is: info@for-rest.ca. Keep in mind that once your trip payments become non-refundable as delineated in our cancellation policy above, there will be NO refunds, and you will need to report your cancellation to your trip cancellation insurance provider for reimbursement. EXHALE ADVENTURES/FOR-REST RETREAT reserves the right to cancel any trip prior to departure for any reason whatsoever, including an insufficient number of participants or logistical problems (e.g. acts of God, war, strikes, etc.), which may impede trip operations. The refund of all payments as described in the paragraph below shall release EXHALE ADVENTURES/FOR-REST RETREAT from any further liability. A trip cancellation due to insufficient numbers would normally occur at least a month prior to departure, unless acts of God, war, strikes or other events impede our departure causing large numbers of participants opt to cancel participation on the journey in the last days before departure. If a trip is cancelled due to forces beyond our control (acts of God, war, labor strikes, earthquake, flooding, etc.), EXHALE ADVENTURES/FOR-REST RETREAT will promptly refund the portion of the trip cost not advanced to suppliers. EXHALE ADVENTURES/FOR-REST RETREAT will use its best efforts to recover advance payments as promptly as possible, and will refund to you the amount recovered, if any. However, EXHALE ADVENTURES/FOR-REST RETREAT does not guarantee recovery of any or all of the advance payments made, and our use of best efforts to recover these payments will not include the institution of any legal proceeding in foreign lands. This policy applies to a trip cancellation by client choice following any necessary increase in trip costs.

KNOWING AND VOLUNTARY EXECUTION

I have carefully read and fully understand the contents of this agreement. I am aware, that this is a release of liability and a legally binding and enforceable contract between myself and FOR-REST RETREAT, EXHALE ADVENTURES, Johanna Mickle & Chevayo Roddick, and I sign it of my own free will
